Introduction These Terms and Conditions of Use (“Terms and Conditions”) govern access to and use of the Dunkest service (“Dunkest” or the “Service”), provided by Fantaking Interactive S.r.l., with registered office at Via San Zeno 145, 25124 Brescia (BS), Italy, VAT No. 03549330987, email: (“Fantaking”). By registering for Dunkest, accessing or using the Service, or purchasing any paid service, the User accepts these Terms and Conditions. If the User does not agree with these Terms and Conditions, they must not use the Service. *** ### 2. Definitions For the purposes of these Terms and Conditions: * “Dunkest” means the digital fantasy sports platform operated by Fantaking and available through the website [www.dunkest.com](http://www.dunkest.com) and the official Dunkest applications available for iOS and Android. * “Service” or “Game” means the Dunkest fantasy sports service and all related features, functionality and content made available by Fantaking. * “User” means any natural person accessing or using Dunkest. * “Account” means the personal account created by the User to access the Service. * “Fantasy Pass” means the optional paid subscription that provides access to additional Dunkest features and benefits. * “Paid Services” means any paid features, subscriptions, products or services made available through Dunkest. *** ### 3. Purpose of the Service Dunkest is a fantasy sports platform that allows Users to create and manage fantasy teams and participate in fantasy competitions based on sporting events and related statistics. The features, rules, scoring systems, competitions and mechanics of the Game may vary depending on the specific competition and may be updated, modified or discontinued by Fantaking in accordance with these Terms and Conditions. Participation in any competition is subject to the specific rules and conditions applicable to that competition. *** ### 4. Registration and Account Creation Certain features of Dunkest require the User to create an Account. When registering, the User must provide accurate, complete and up-to-date information and must promptly update such information whenever necessary. The User is responsible for ensuring that the information associated with their Account remains accurate. Fantaking reserves the right to refuse or suspend the creation of an Account where there are reasonable grounds to believe that the information provided is inaccurate, fraudulent or intended to circumvent these Terms and Conditions. *** ### 5. One Account per User Unless expressly permitted by the specific rules of a competition, each User may create and use only one Dunkest Account. The creation or use of multiple Accounts for the purpose of obtaining an unfair advantage, circumventing restrictions or otherwise manipulating the Service is prohibited. Fantaking may take appropriate measures, including the suspension or closure of Accounts, where multiple Accounts are used in violation of these Terms and Conditions or the applicable competition rules. *** ### 6. Account Credentials and User Responsibility The User is responsible for keeping their login credentials confidential and for all activity carried out through their Account. The User must immediately notify Fantaking if they become aware of any unauthorized access to their Account or any other security issue. The User must not share, transfer, sell or otherwise make their Account available to third parties. Fantaking shall not be responsible for any unauthorized use of an Account resulting from the User’s failure to adequately protect their credentials, except where otherwise required by applicable law. *** ### 7. Participation in the Game and Competition Rules Participation in Dunkest competitions is governed by the specific rules applicable to each competition. The User agrees to comply with: * these Terms and Conditions; * the specific rules of each competition; * any instructions communicated by Fantaking; * applicable laws and regulations. Fantaking may correct technical errors, statistical errors or other objectively verifiable inaccuracies affecting the Game or the calculation of scores. Where necessary to ensure the correct and fair operation of a competition, Fantaking may make adjustments to rankings, scores or other Game elements in accordance with the applicable rules. *** ## 8. In-App Purchases and Paid Services Dunkest may offer optional paid features, products and subscriptions. Before completing a purchase, the User will be provided with information regarding the applicable price, duration, characteristics and conditions of the relevant Paid Service. Payments for purchases made through the Dunkest mobile applications may be processed through the payment systems of Apple App Store or Google Play, depending on the User’s device and purchase method. The purchase is completed in accordance with the terms and conditions applicable to the relevant payment platform. Once the purchase has been successfully completed, the relevant Paid Service will normally be activated within 24 hours. For assistance concerning a purchase, the User may contact Fantaking at . *** ## 9. Fantasy Pass The Fantasy Pass is an optional paid subscription providing access to additional Dunkest features and benefits. The features and benefits included in the Fantasy Pass are displayed to the User before purchase and may include, depending on the selected plan: * access to prizes; * additional credits; * unlimited daily trades; * removal of advertising; * notifications regarding players who are out; * notifications regarding players who are in form; * probability-of-playing information; * access to the Dunkest Pass Telegram channel; * other features expressly indicated at the time of purchase. The Fantasy Pass may be purchased for one or more fantasy teams, according to the plans available at the time of purchase. The applicable price and the features included in each plan are clearly indicated before the purchase is completed. *** ## 10. Duration and Automatic Renewal of the Fantasy Pass The Fantasy Pass has a duration of 12 months from the date on which it is activated. At the end of the 12-month period, the subscription will automatically renew for a further 12-month period unless the User has disabled automatic renewal before the renewal date. The renewal will be charged at the price applicable to the subscription at the time of renewal, in accordance with the information and procedures provided by the relevant payment platform. The User may disable automatic renewal at any time. Disabling automatic renewal does not terminate the Fantasy Pass immediately: the User will continue to have access to the subscribed features until the end of the current paid subscription period, unless otherwise provided by applicable law. *** ## 11. Payments, Renewals and Refunds All prices are displayed to the User before the purchase is completed. Where a Fantasy Pass is subject to automatic renewal, the User will be charged automatically at the end of each subscription period unless automatic renewal has been disabled. The User’s failure to use the Fantasy Pass or its features does not, by itself, entitle the User to a refund. Refunds are governed by applicable law and, where relevant, by the procedures and policies of the payment platform through which the purchase was made. If the User is charged for a renewal after having correctly disabled automatic renewal, they may contact Fantaking at for assistance. Nothing in these Terms and Conditions limits any mandatory consumer rights applicable under law. *** ## 12. Right of Withdrawal Where applicable under mandatory consumer protection legislation, the User who qualifies as a consumer may exercise the statutory right of withdrawal within the applicable period and under the conditions established by law. Where the right of withdrawal applies, the User may exercise it by contacting Fantaking at: The User may communicate their decision to withdraw by means of an unequivocal statement, including the following information: * name and surname; * email address associated with the Dunkest Account; * identification of the service or subscription concerned; * clear statement that the User wishes to exercise the right of withdrawal. Where required by applicable law, Fantaking will provide the User with confirmation of receipt of the withdrawal request on a durable medium. Where the User expressly requests that the Service begin before the expiry of the statutory withdrawal period, the rules applicable to services supplied during the withdrawal period shall apply, including any applicable provisions concerning the amount due for the service already supplied. The statutory exceptions to the right of withdrawal provided for by applicable law shall also apply. *** ## 13. Cancellation of Subscriptions Purchased through Apple or Google Subscriptions purchased through the Apple App Store or Google Play must be managed through the Apple or Google account used for the purchase. In particular, disabling automatic renewal must be carried out through the relevant subscription management settings provided by Apple or Google. Uninstalling the Dunkest application does not cancel a subscription and does not automatically disable its renewal. Fantaking may provide assistance regarding subscription management, but cancellation must be completed through the relevant payment platform where required by that platform. *** ## 14. Use of the Service The User agrees to use Dunkest only for lawful purposes and in accordance with these Terms and Conditions. The User must not: * use the Service for fraudulent or unlawful purposes; * interfere with the operation or security of the Service; * attempt to gain unauthorized access to systems, accounts or data; * use automated systems, bots, scripts or other tools to manipulate the Service, except where expressly authorized by Fantaking; * exploit technical errors or vulnerabilities; * reproduce, copy, distribute or commercially exploit the Service or its content without authorization; * engage in activities intended to manipulate rankings, scores, competitions or other Game mechanisms; * otherwise use the Service in a manner that may damage Fantaking, other Users or the proper functioning of Dunkest. Fantaking may take appropriate measures in response to violations of these Terms and Conditions or the applicable competition rules. *** ## 15. Intellectual Property All intellectual property rights relating to Dunkest, including but not limited to software, trademarks, logos, graphics, interfaces, texts, databases, audiovisual content, Game mechanics, layouts and other materials made available through the Service, are owned by Fantaking or licensed to Fantaking by their respective rights holders. The User is granted a limited, personal, non-exclusive, non-transferable and revocable right to use the Service for its intended purposes. No rights other than those expressly granted under these Terms and Conditions are transferred to the User. Any reproduction, modification, distribution, publication or commercial exploitation of Dunkest or its content without prior authorization is prohibited. *** ## 16. Availability of the Service Fantaking will use reasonable efforts to ensure the availability and proper functioning of Dunkest. However, the Service may occasionally be unavailable or temporarily interrupted due to: * maintenance; * technical problems; * software or hardware failures; * network or connectivity problems; * circumstances beyond Fantaking’s reasonable control; * third-party services or infrastructure; * other events that cannot reasonably be prevented or controlled by Fantaking. Fantaking may temporarily suspend access to all or part of the Service where necessary for maintenance, security or technical reasons. Nothing in these Terms and Conditions excludes or limits any liability that cannot legally be excluded or limited. *** ## 17. Assistance and Complaints For assistance, technical support or complaints relating to Dunkest, the User may contact Fantaking at: The User should provide sufficient information to allow Fantaking to identify the Account and understand the issue, including, where relevant, the order number, date of purchase and description of the problem. Fantaking will handle requests within a reasonable time, taking into account the nature and complexity of the issue. *** ## 18. Suspension or Termination of an Account Fantaking may suspend or terminate an Account, temporarily or permanently, where the User: * materially breaches these Terms and Conditions; * violates the rules of a competition; * engages in fraudulent or abusive behavior; * attempts to manipulate the Service or competitions; * uses multiple Accounts in violation of the applicable rules; * carries out activities that may compromise the security or proper functioning of Dunkest; * otherwise engages in conduct that is unlawful or materially harmful to Fantaking or other Users. Where appropriate and permitted by law, Fantaking may provide the User with notice of the relevant breach and an opportunity to remedy it. Any suspension or termination will be carried out in accordance with applicable law. *** ## 19. Deletion of the Account The User may request the deletion of their Dunkest Account by contacting Fantaking at: The deletion of a Dunkest Account does not automatically cancel subscriptions purchased through Apple App Store or Google Play. The User must separately disable automatic renewal through the relevant Apple or Google account where applicable. The deletion of an Account does not affect any rights or obligations that, by their nature, are intended to survive termination of the relationship between the User and Fantaking. *** ## 20. Personal Data The processing of the User’s personal data is governed by Fantaking’s Privacy Policy, which forms an integral part of the information provided to Users in connection with the Service. The Privacy Policy explains how personal data is collected, used, stored and processed and describes the rights available to Users under applicable data protection legislation. *** ## 21. Amendments to the Terms and Conditions and the Service Fantaking may modify these Terms and Conditions where reasonably necessary, including to: * comply with legal or regulatory requirements; * introduce or modify features of the Service; * improve security; * reflect changes to the Service or its business operations; * correct errors or ambiguities. Where required by applicable law, Users will be informed of material changes within the applicable notice period. Where a User has a statutory right to withdraw from or terminate the contractual relationship as a result of a material modification, such right may be exercised in accordance with applicable law. Fantaking may also modify, introduce, suspend or discontinue individual features of Dunkest, provided that mandatory consumer rights are respected. *** ## 22. Communications Fantaking may communicate with Users by email, through the Dunkest application, through the website or by other appropriate electronic means. Communications concerning the Account, purchases, subscriptions, security, changes to the Service or these Terms and Conditions may be sent to the email address associated with the User’s Account. The User is responsible for keeping their contact information up to date. *** ## 23. Limitation of Liability Fantaking shall be liable for damages directly attributable to its breach of obligations under these Terms and Conditions to the extent provided by applicable law. Fantaking shall not be responsible for interruptions, delays or failures caused by circumstances beyond its reasonable control, including failures of third-party services, telecommunications networks, hosting providers, payment platforms or other external infrastructure, except where otherwise required by law. Nothing in these Terms and Conditions excludes or limits liability for matters that cannot legally be excluded or limited. *** ## 24. Term and Termination of the Terms and Conditions These Terms and Conditions apply from the moment the User accepts them or begins using the Service, as applicable. They remain in force for as long as the User uses Dunkest or maintains an Account, subject to any provisions that by their nature continue to apply after termination. The termination or deletion of an Account does not affect rights or obligations accrued before termination. *** ## 25. Applicable Law and Jurisdiction These Terms and Conditions are governed by Italian law, without prejudice to any mandatory provisions of consumer protection law applicable to the User. Where the User qualifies as a consumer, any mandatory rules concerning jurisdiction and the competent court shall apply, including the rules providing for jurisdiction based on the User’s place of residence or domicile where applicable. For Users who do not qualify as consumers, the courts having jurisdiction under applicable Italian law shall have jurisdiction. *** ## 26. Final Provisions If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions shall remain fully effective to the extent permitted by law. The failure by Fantaking to enforce any provision of these Terms and Conditions shall not constitute a waiver of its right to enforce that provision at a later date. These Terms and Conditions, together with the specific rules applicable to individual competitions, the Privacy Policy and any other documents expressly incorporated herein, constitute the contractual framework governing the use of Dunkest. For any matter not expressly addressed in these Terms and Conditions, the applicable provisions of Italian and European law shall apply.
